These Terms of Use ("Terms") constitute a legally binding End User License Agreement ("EULA") between you and My Day LLC ("we," "us," or "our") governing your use of the My Day mobile application ("App"). By downloading, installing, or using the App, you agree to be bound by these Terms.

By accessing or using My Day, you confirm that you have read, understood, and agree to these Terms. If you do not agree, please do not use the App. If you are a parent, guardian, or caregiver accepting these Terms on behalf of a minor or an individual under your care, you accept these Terms on their behalf and are responsible for their use of the App.

My Day is a daily routine and communication support application designed for individuals with intellectual disabilities. The App provides task scheduling, communication cards (AAC board), mood tracking, reward systems, and caregiver management features. The App is intended as a supportive tool and is not a medical device or a substitute for professional care.

We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on any Apple-branded device you own or control, subject to the Usage Rules set forth in the Apple Media Services Terms and Conditions. This license does not allow you to distribute, sublicense, or make the App available over a network where it could be used by multiple devices at the same time.

My Day offers a free Basic plan and an optional premium subscription ("My Day Pro").

• Pricing: My Day Pro is available as an auto-renewable monthly subscription at the price displayed in the App at the time of purchase (currently $4.99/month USD).
• Free Trial: A 7-day free trial may be offered to eligible new subscribers. If you do not cancel before the trial ends, you will be automatically charged the subscription price.
• Payment: Payment is charged to your Apple ID account at confirmation of purchase.
• Renewal: Your subscription automatically renews each month unless you cancel at least 24 hours before the end of the current billing period.
• Cancellation: You can cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
• Price Changes: We may change subscription pricing from time to time. Any price changes will take effect at the start of the next billing period following notice to you.

The App stores your data (tasks, contacts, settings, mood entries) locally on your device using on-device storage. We do not collect, transmit, or store your personal data on our servers. You are responsible for backing up your device to avoid data loss. Please review our Privacy Policy for full details on how we handle your information.

You agree not to:

• Reverse engineer, decompile, or disassemble the App
• Modify, adapt, or create derivative works based on the App
• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to any part of the App
• Remove, alter, or obscure any proprietary notices in the App

The App, including its design, features, content, and code, is owned by My Day and is protected by intellectual property laws. All rights not expressly granted in these Terms are reserved.

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. My Day is a supportive tool and should not be relied upon as a sole means of communication, emergency contact, or medical care.

To the maximum extent permitted by applicable law, Figment and Facts shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount you have paid us in the twelve months preceding the claim.

The App may integrate with third-party services such as RevenueCat for subscription management. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

We may terminate or suspend your access to the App at any time, without prior notice, if you breach these Terms. Upon termination, your license to use the App is revoked. Sections related to intellectual property, disclaimers, and limitation of liability survive termination.

We may update these Terms from time to time. The updated Terms will be posted within the App or on our website with a new effective date. Your continued use of the App after changes constitutes acceptance of the revised Terms.

These Terms are between you and Figment and Facts, not Apple. Apple has no obligation to furnish maintenance or support for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any); beyond that, Apple has no warranty obligation. Apple is not responsible for addressing any claims relating to the App. Apple is a third-party beneficiary of these Terms and may enforce them against you.

These Terms are governed by the laws of the United States of America and the state in which My Day  operates, without regard to conflict of law principles.
